01 / About These Terms
These Terms & Conditions govern general access to and use of the Imperial CyberX website. By using the website, you agree to use it lawfully and in accordance with these terms. If you do not agree, discontinue use of the website.
These general website terms do not, by themselves, define every obligation for a commissioned project. A written proposal, quotation, statement of work, confidentiality agreement or signed client contract may set additional terms for that engagement. Where a valid project-specific agreement conflicts with these general terms, the project-specific agreement will govern the conflicting service matter to the extent permitted by law.
02 / Business Identity
Imperial CyberX is a trade name used by Sheikh Junayed Ahmed, an individually owned and operated remote digital and cybersecurity services business based in Electronic City Phase 1, Bengaluru, Karnataka, India. It is not incorporated as a company and is not registered as an LLP. The trade name is not a legal person separate from the proprietor.
This description does not state that no registration or licence can be required. Tax, establishment, local licensing, consumer-protection and other obligations are determined by applicable law and the actual business activities and circumstances.
03 / Services and Engagements
Website material may describe digital services, web development, IT consulting, cybersecurity work, technical research and related capabilities. Service availability, scope, delivery dates, fees, acceptance criteria, support, warranties, maintenance and deliverables are agreed separately for each project where applicable.
Website descriptions are general information, not a binding guarantee that a particular service, feature, result, timeline or price will be available. A service begins only when the relevant scope and commercial terms have been accepted through an appropriate written arrangement.
Unless a written agreement states otherwise, the client is responsible for providing accurate requirements, timely approvals, necessary access, lawful instructions, backups, and the permissions needed for the requested work.
04 / Cybersecurity and Authorised Testing
Security assessments, vulnerability testing, scanning, penetration testing, incident investigation and similar work must be performed only within an agreed and authorised scope. The client or requester must have the right to authorise testing of the relevant systems, accounts, networks, applications and data.
- Authorisation, target assets, permitted methods, testing window, exclusions and escalation contacts should be agreed before testing begins.
- Do not use Imperial CyberX website content or services as permission to access, test, disrupt, monitor or alter a system that you do not own or have explicit authority to assess.
- Testing can affect availability, data or connected services. The parties should agree backups, recovery arrangements, emergency contacts and the handling of findings before work starts.
- Findings and recommendations describe observations and professional judgments within the agreed scope and time. They are not a guarantee that all vulnerabilities have been identified or that future incidents will be prevented.
No statement on this website authorises unlawful access, interception, disruption, data extraction or other prohibited conduct.
05 / Acceptable Use
You must not misuse the website, attempt to bypass access controls, introduce malicious code, interfere with its availability, impersonate another person, submit unlawful content, infringe another party’s rights, or use the website to facilitate unauthorised or unlawful activity.
You must not misrepresent your authority over an asset submitted for cybersecurity work, or provide information that you know to be materially false. We may restrict access or decline an enquiry where reasonably necessary to protect the website, users, clients or legal interests, subject to applicable law and any existing contractual obligations.
06 / Intellectual Property
Unless otherwise stated, the website’s original text, visual design, branding, graphics and other materials are owned by or used under licence by the relevant rights holder. These terms do not grant you ownership of Imperial CyberX branding or website materials. You may view the website and use its public content for ordinary, lawful informational purposes; copying, republishing, modifying or commercially exploiting protected material requires permission where permission is required by law.
Ownership, licensing, source-code delivery, reuse rights and restrictions for commissioned deliverables should be specified in the applicable project agreement. A client’s pre-existing materials remain subject to the client’s rights, and third-party or open-source components remain subject to their respective licences.
07 / Fees, Payment and Cancellation
Any price, payment milestone, expense, cancellation arrangement, refund, maintenance term or support commitment for a service must be stated in the applicable quotation or written agreement. Do not assume that a website description is a complete commercial offer.
Nothing in these general terms is intended to remove or limit any consumer right, refund entitlement or other protection that cannot lawfully be excluded. If a project agreement does not resolve a particular issue, the parties’ rights will be determined under the applicable law.
08 / Third-Party Links and Services
The website may refer to external websites, software, platforms, hosting services, code repositories or other third-party resources. Those services may operate under separate terms, security practices, licences and privacy policies. A link or reference does not automatically mean that Imperial CyberX endorses or controls the third party.
Before relying on an external service, review its terms and assess whether it is appropriate for the relevant information or project.
09 / Availability and General Disclaimers
We seek to keep the website useful and current, but we do not guarantee uninterrupted availability, error-free operation, or that every item of general information will remain current at all times. Website content is provided for general information and is not a substitute for an engagement-specific assessment or professional advice tailored to your circumstances.
To the extent permitted by applicable law, the website and its general content are provided without a guarantee that they will meet every individual requirement. This wording does not override an express written commitment made in a valid service agreement or any warranty or right that cannot lawfully be excluded.
10 / Liability
Each party remains responsible for the obligations imposed on it by applicable law and any valid agreement. To the extent permitted by law, neither general website content nor an illustrative description of a service should be treated as a guarantee of a particular technical outcome.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including any applicable non-excludable statutory rights or protections. Any further allocation of risk, indemnity, liability cap or remedy for a commissioned service must be assessed under the applicable written agreement and law.
11 / Privacy and Information Handling
Use of the website is also subject to the Privacy Policy, which describes information that may be processed and how privacy requests can be raised. Specific client engagements may require additional confidentiality, data-handling, access-control or security terms in writing.
Users should not transmit credentials, private keys or sensitive project data through public channels unless an appropriate secure process has been agreed.
12 / Changes and Suspension
These terms may be revised when the website or services change or when applicable law requires an update. The date at the top identifies the latest published revision. Continued website use after a revision is subject to the updated terms to the extent permitted by law; changes to an existing service contract will be handled under that contract and applicable law.
Where reasonably necessary, access to the website may be suspended or restricted to address security concerns, unlawful use, technical issues or legal requirements. This does not remove rights or obligations that have already accrued under applicable law or a valid agreement.
13 / Governing Law and Disputes
These terms are interpreted subject to the laws of India. Disputes are subject to the jurisdiction of competent courts, tribunals or other fora as determined by applicable law. Nothing in this clause is intended to override mandatory jurisdiction rules or statutory consumer protections.
14 / Contact
For questions about these terms, a service proposal or a legal notice, contact the proprietor through the Contact section of the official website, identifying the relevant enquiry or engagement where appropriate.
